Philadelphia Workers’ Compensation Lawyers Fight for the Just Compensation You Deserve

Workplace injuries and work-related medical conditions are often catastrophic, resulting in your inability to work and provide for yourself and your family. To ensure that you receive the compensation you are entitled to, it is vital that you report injuries immediately, keep accurate records of your medical treatments and expenses and consult an experienced Workers’ Compensation attorney. At McCann Dillon Jaffe & Lamb, LLC, our Philadelphia Workers’ Compensation lawyers have more than five decades of combined experience working with employers, insurance companies and third parties to get our clients the lost wage benefits they need to move on in the best possible position.

We Provide the Legal Resources and Advice You Need to Understand how Lost Wage Benefits are Calculated

The Pennsylvania Workers’ Compensation Act provides for several different types of benefits that vary in eligibility depending upon your specific circumstances. If your workplace injury or medical condition has left you fully or partially disable and unable to work, you are entitled to lost wage benefits. Under the law, there are several different ways that lost wages are calculated. Lost wage compensation usually covers two-thirds of the amount you were earning on a weekly basis prior to your injury, subject to a weekly maximum. The minimum amount allowable is either 90% of your average weekly salary or 50% of the average weekly wage in Pennsylvania, whichever is lower.

Will I Automatically Receive Lost Wage Compensation if I Miss Work Due to a Work-Related Injury?

To be eligible for lost wage benefits, you must be out of work for at least a specified period of time. If you miss work for:

  • Seven or fewer days you are not eligible for lost wage benefits
  • Eight to 14 days you are eligible for compensation after a seven day waiting period and thus will be compensated for up to seven days
  • More than 14 days you are eligible for full compensation beginning on the first day you were injured

Payments for lost wages are paid out roughly three weeks from your date of eligibility and are made on a regular basis for the duration of your coverage. The most important step in determining eligibility for lost wages is to immediately report your injury and keep accurate and detailed records of the medical care you receive. Our Philadelphia Workers’ Compensation lawyers place your best interests at the forefront and take pride in fighting for your rights.
