Were You Injured in a Trucking Accident as a Result of Improper Maintenance or Safety Violations?
The Federal Motor Carrier Safety Administration (FMCSA) reports that in 2015 there were approximately 415,000 police-reported accidents involving large trucks with 3,598 of them being fatal crashes and 83,000 being injury crashes.
The Philadelphia truck accident lawyers at McCann Dillon Jaffe & Lamb, LLC, work to protect the rights of trucking accident victims in Pennsylvania, Delaware and New Jersey. If you were injured or you lost a family member in a commercial truck accident, you may be entitled to compensation for your losses. You can rely on our firm for dedicated, compassionate service as we pursue your injury or wrongful death claim.
Trucking Companies Are Required to Perform Safety Inspections
The Federal Motor Carrier Safety Administration regulations mandate that every motor carrier and intermodal equipment provider must systematically inspect, repair and maintain, or cause to be systematically inspected, repaired and maintained, all vehicles and equipment under its control. In addition, the transportation company must keep records of the maintenance inspections.
If a truck is found to be unsafe or in need of repairs, the FMCSA states that no one is permitted to operate the truck and it is marked “out of service” until all repairs required by the out-of-service notice have been satisfactorily completed. Records of the repairs must be kept by the trucking company.
We will investigate the cause of your accident and determine liability. If the trucking company failed to perform regular maintenance checks and make necessary repairs, we will hold it accountable for injuries or deaths caused by this negligence.
