 The 3M Company continues to face lawsuits across the country based on hip and knee infections caused by their defective Bair Hugger forced air warming system, which is used to regulate patients’ temperature during surgery. As of January 2017, more than 1,000 cases were pending in Minnesota where 3M Company’s headquarters are located. The lawsuits allege that the defective design of the warming system left patients vulnerable to deep joint infection while undergoing hip and knee replacement surgery.

Bair Hugger blankets have been used by more than 200 million patients worldwide since their introduction in 1987. Designed to regulate the patient’s body temperature during surgery, the 3M Bair Hugger is comprised of a disposable, inflatable blanket attached to a heater/blower device. The heater takes the air in the room, heats it, and then sends it through a hose to the blanket which is distributed over the patient. The blanket keeps the patient warm and prevents hypothermia. Bair Hugger forced air blankets are used during heart and abdominal procedures, and in most knee and hip implant surgeries.

The Bair Hugger lawsuits allege that the defective design of the Bair Hugger patient warming blanket caused them to suffer deep joint infections including sepsis and MRSA. Because the Bair Hugger takes in air around the room, it disrupts the flow of the air in the room, transporting contaminants to the patient’s open wound during surgery. Those contaminants can cause debilitating infections in patients, leaving them at risk for additional surgery, disabilities, or even fatality.

The Company May Have Had Prior Knowledge

At the heart of the litigation against 3M is the claim that the company has known since 2009 that Bair Hugger blankets were defective medical devices, yet still assured physicians that they were safe for patients, without making any changes to their design. The lawsuits also allege that 3M failed to warn physicians of the risk of patient infection inherent in the Bair Hugger design – preventing them from making informed decisions about the safety of their patients.
